DEYA Terms of Use

1. Introduction

Welcome to Deya! These Terms of Service are a legally binding agreement between you and Intersubject OU, operating under the trade name 'Deya' (hereinafter — 'Deya', 'we', 'us', 'our'). Please read these Terms carefully before using our platform.

By using the website, mobile applications, or any other services provided by Deya (collectively, the 'Platform' or 'Services'), you confirm that you have read, understood, and agree to comply with these Terms of Service. If you do not agree to these Terms, you should not use our Services.

  • 1.1. Purpose of the Terms: These Terms of Service, which we may update from time to time, apply to the Deya Platform. They are important as they help define our relationship with you and the rules for using our Services.
  • 1.2. Acceptance of Terms: By using any Services, you enter into an agreement with Intersubject OU and agree to these Terms. This means you understand and accept all the rules, whether you are making a contribution as a Donor, creating a campaign as an Organizer, or are a Beneficiary.

2. Definitions

  • * Account: A unique account created by a user to access Deya Services.
  • * Beneficiary: An individual or legal entity (including non-profit organizations) for whose benefit a Fundraising Campaign is conducted.
  • * Donor: An individual or legal entity who makes a voluntary donation to a Fundraising Campaign through the Platform.
  • * Fundraising Campaign: A campaign initiated on the Platform to raise funds for a specific purpose for the Beneficiary.
  • * User Content: Any content (text, images, video) that a User posts or uploads to the Platform.
  • * NGO (Non-Profit Organization): An officially registered non-profit or public organization in Ukraine that has been verified on the Deya Platform.
  • * Organizer: An individual or legal entity who initiates and manages a Fundraising Campaign on the Platform.
  • * Platform: The entire set of online services provided by Deya, including the website, mobile applications, and related technologies.
  • * User: Any person who accesses or uses the Platform, including Organizers, Donors, and Beneficiaries.

3. The Services We Provide

  • 3.1. Description of Services Provided: We offer a technological Platform that allows Organizers to create Fundraising Campaigns to attract donations from Donors for themselves or third parties (Beneficiaries).
  • 3.2. Our Role and Limitations: Our Platform is only a tool. Deya is not a bank, broker, financial institution, lender, or charity. We do not provide financial, legal, or tax advice. All information on the Platform is for informational purposes only. We do not control the activities of Users and cannot guarantee that funds will be used as intended, although we make every effort to do so in accordance with our Trust and Safety Policy. The decision to make a donation is your personal responsibility.
  • 3.3. Modification of Services: We reserve the right to change, suspend, or discontinue all or part of the Services at any time with or without notice.

4. Account Creation and Requirements

  • 4.1. Registration: You agree to provide true, accurate, and complete information during registration and to keep it up to date. To launch a Fundraising Campaign, each Organizer must undergo a mandatory identity verification procedure.
  • 4.2. Age Restrictions: The Platform may be used by persons who are at least 18 years old or have full legal capacity according to the laws of Ukraine. Persons aged 14 to 18 may use the Platform only with the permission and under the supervision of parents or legal guardians.
  • 4.3. Account Security: You are fully responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

5. Payment Processors

Deya does not store funds or process payments itself. We use third-party payment processors that comply with security standards (PCI-DSS). By making a donation or creating a Fundraising Campaign, you agree to the terms of the respective payment processors. We do not store your payment card data.

6. User Obligations

  • 6.1. Organizer Obligations:
    • * Provide accurate and truthful information about the purpose of the Fundraising Campaign.
    • * Clearly and thoroughly describe how the collected funds will be used.
    • * Use funds exclusively for the stated purpose.
    • * Publish updates for Donors at least once a month to ensure transparency and accountability.
    • * Respond to Donor inquiries promptly and professionally.
    • * Cooperate with Deya in case of requests for additional information or proof of fund usage.
  • 6.2. Donor Obligations:
    • * Carefully review information about the Fundraising Campaign before making a donation.
    • * Understand that all donations are voluntary and final, except as provided by our refund policy.
    • * If in doubt, contact the Organizer for additional information.
    • * Immediately report any suspicious or fraudulent campaigns to Deya using the 'Report' button.
  • 6.3. Tax Obligations: You are fully responsible for determining and paying all taxes arising in connection with receiving donations. Deya does not provide tax advice and does not withhold taxes.

7. Prohibited Fundraising and User Content

You agree not to use the Platform to create Fundraising Campaigns or post content that:

  • * Is fraudulent, inaccurate, or misleading.
  • * Violates any law or regulation.
  • * Promotes hatred, discrimination, violence, terrorism.
  • * Is related to illegal activities, drugs, weapons, pornography.
  • * Includes gambling, lotteries, raffles, or investment schemes.
  • * Involves equity-based crowdfunding (offering a share in a business or income).
  • * Violates third-party intellectual property rights.
  • * Promotes suicide or self-harm.

We reserve the right, at our sole discretion, to remove any content, suspend or cancel any Fundraising Campaign, and block accounts that violate these rules.

8. Refund Policy

Refunds are possible if a campaign is found to be fraudulent or grossly violates our Terms. We consider each case individually. If funds have already been transferred to the Beneficiary, we will make efforts to cooperate with the Organizer to resolve the situation.

9. Intellectual Property

  • 9.1. Our Property: The name 'Deya', logo, software, and all content created by us are our intellectual property. You may not use them without our prior written permission.
  • 9.2. Your Property: You grant us a worldwide, perpetual, royalty-free license to use, copy, modify, and distribute User Content you upload to the Platform for the purpose of providing and promoting the Services. You warrant that you have all necessary rights to such content.
  • 9.3. Copyright Complaints: If you believe your work has been copied in violation of copyright, please send us a notice at info@thedeya.com with details of the infringement. info@thedeya.com

10. Disclaimer of Warranties and Limitation of Liability

  • 10.1. Disclaimer of Warranties: The Services are provided 'as is' and 'as available'. We make no warranties that the Services will be uninterrupted, secure, or error-free, or that the information on the Platform will be accurate or reliable.
  • 10.2. Limitation of Liability: To the extent permitted by applicable law, Deya is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Services.

11. Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Ukraine. Any disputes, disagreements, or claims arising out of or in connection with these Terms shall be resolved in the courts of Ukraine in accordance with established jurisdiction.

12. Miscellaneous

  • 12.1. Changes to the Terms: We reserve the right to change these Terms at any time. We will post the updated version on this page and indicate the date of the last update. Continued use of the Platform after changes means your acceptance of them.
  • 12.2. Entire Agreement: These Terms constitute the entire agreement between you and Deya.
